Filing For Divorce In Ohio's Domestic Relations Division Of The Common Pleas Court
In Ohio, family law disputes are heard in the Domestic Relations Division of the Common Pleas Court. In order to file for a divorce in Ohio, you must be an Ohio resident. This means you must have lived in Ohio for at least six months. If both you and your spouse are Ohio residents, you can file in either the county in which you reside, or the county where your spouse lives.
The next step is to bring your spouse under jurisdiction of the Ohio courts by serving him or her with divorce papers. Once your divorce action has been properly initiated in Ohio, the state will have jurisdiction over you, your spouse and your children.
Society has become increasingly mobile. Many people relocate throughout the United States and abroad. When spouses live in different states, or different countries, choosing the court in which to file your family law action can become complicated. If you file an action in a court that does not have jurisdiction over you or your spouse, your claim will be dismissed. It is important to work with an experienced attorney who can advise you on the appropriate court in which to bring your claim.
Under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), states must respect each other's divorce, child custody and support orders. If you have a valid court order from another state, it will be enforced in Ohio. Similarly, if an Ohio court has issued custody, support or divorce orders, you can enforce those rights outside of Ohio.
