Certain types of retirement assets — including 401(k)s, pension plans and employee stock ownership plans — cannot be divided by a divorce decree. Instead, a qualified domestic relations order (QDRO) is required.

QDROs are subject to many federal requirements. In order to validly divide these retirement accounts, a QDRO must contain the following:

  • The name and address of the plan participant
  • The name and address of the ex-spouse
  • A dollar amount of percentage to be paid
  • The duration of payments
